Principles of Refinement and Refinement of the Fundamentals

المستخلص

لقد اعتنى العلماء قديمًا وحديثًا بتقريب كتب أهل العلم بالتهذيب والاختصار؛ لعل الهمم أن تنشط لقرائتها؛ وذلك لِما رأوا من كثرت الصوارف والمشغلات، وضعف الهمم، وقصورها عن الطلب، فأحببت أن أكتب مقدمة عن التهذيب، تبين حدوده وضوابطه، ومجالاته في أصول الفقه؛ لعلها تكون نبراسًا لمن أراد الكتابة في هذا المجال، وقد جاء البحث في مقدمة، وأربعة مباحث، تكونت المباحث مما يلي: المبحث الأوَّل: تعريف التهذيب، المبحث الثاني: ضوابط التهذيب، المبحث الثالث: مجالات التهذيب في الكتب الأصولية، أو المسوغات العلمية للتهذيب. المبحث الرابع: نماذج من تهذيب واختصار الكتب الأصولية. وقد توصل الباحث إلى نتائج منها: أولاً: أن لا يقصد بهذا العمل التنقص والحط من قدر المؤلف أو الكتاب، فللعلماء قدرهم وجلالتهم، وحقهم محفوظ مصون، وإن اخطأوا فهم دائرون في فلك الأجر والأجرين. ثانيًا: أن يستشعر مراقبة الله U، ولا يقدم على هذا إلا من له قدم راسخة في العلم، حفظًا وصونًا لتراث الأمة من العبث واللعب. ثالثًا: أن يكون ملمًا ومدركًا لعبارات العلماء وأساليبهم. رابعًا: أن يكون على معرفة ودراية تامة بمقصود المؤلف من كتابه، قبل تهذيبه، حتى لا يخرج الكتاب عن مقصود مؤلفه. خامسًا: أن لا يحذف من المسائل إلا ما أغنى غيره عنه، مما أمكن الاستغناء عنه، ولا أثر لحذفه في فهم المسألة. سادسًا: أن تكون إضافاته وزيادته على الكتب المهذب، مقيَّدة بإضافات وفوائد عزيزة مهمة لا يكتمل رونق الكتاب وتهذيبه إلا بها، وتكون بعبارات وإشارات موجزة مختصرة. سابعًا: أن يكون اختصاره للكتاب بعبارة سهلة موجزة واضحة، بعيدة عن التعقيد والإلغاز.

ABSTRACT

The scholars, in the past and the present, took interest in bringing the books of the people of knowledge close with refinement and summarization, perhaps it will boost the morale to read it. This is because they saw the abundance of diversions and distractions, and the weakness of determination, and the lack of demand for the books, so I decided to write an introduction to refinement, showing its limits and guidelines, and its areas in the principles of jurisprudence; Perhaps it will be a guiding light for those who wanted to write in this field. The research consist of an introduction, and four chapters. The chapters consisted of the following: The first chapter: the definition of refinement, the second chapter: the guidelines of refinement, the third chapter: areas of refinement in the books of the principles of jurisprudence, or scientific justifications for refinement, the fourth chapter: examples of refinement and summarization of books of the principles of jurisprudence. The researcher arrived at results, including: First: That this work is not intended to belittle and degrade the author or the book, for scholars have their dignity and grandeur, and their right is preserved and protected, and if they err, they are in the path of reward and wages. Second: To be conscious of Allah, and only those who have a firm understanding of the knowledge should engage in this work, to preserve and reserve the Ummah’s heritage from tampering and frolicking. Third: He should be familiar with and aware of the words and methods of scholars. Fourth: He should be fully aware of the author’s intention of his book, before he refines it, so that the book does not deviate from the intention of its author. Fifth: That he should not omit from the issues except what others have sufficed him on it, which could be dispensed with, and its omission has no effect on understanding the issue. Sixth: That his additions to the refined books be limited to valuable additions and important benefits that the luster and refinement of the book would not be complete without them. Seventh: His summarization of the book should be in an easy, concise, and clear phrase, far from complexity and ambiguity.
