Abstract

Abstract

This study examines women’s Rights between the CEDAW Convention and Sudanese Legislation in the Light of Islamic Sharia. The central problem addressed is that many provisions of the CEDAW Convention conflict with Sudanese customs and laws, particularly the issue of absolute equality between men and women. The study argues that CEDAW advocates for the abrogation of religious laws, customs, and legislation. The study aims to analyze the status of Sudanese women and assess compatibility with the Convention's provisions. The study employs a descriptive-analytical approach, reviewing the CEDAW Convention and relevant provisions in some Sudanese legislation, and utilizes a comparative approach comparing the Convention's provisions with Sudanese legislation and Islamic Sharia. The study concludes with several key findings, most notably that CEDAW contains positive aspects aimed at preventing discrimination against women in areas such as civil service, politics, and other rights, and that these aspects align with Sudanese legislation. The study also demonstrated that some provisions in CEDAW conflict with Sudanese legislation, rendering them inapplicable. Furthermore, the study concluded that eliminating discrimination against women, in the sense of absolute equality between men and women, is inconceivable within Sudanese legislation derived from Islamic jurisprudence. The relationship between men and women is not one of equality but rather one of justice. The study recommended active participation in international organizations to defend the culture of Islamic societies and to contribute positively to the development of international legislation.
Keywords: CEDAW, discrimination against women, equality, Sudanese legislation.
