يقوم المستثمرون الأجانب في المملكة العربية السعودية بدور كبير في الإسهام بتنمية الاقتصاد المحلي، وتعزيز علاقات المستثمرين المحليين مع المجتمع التجاري الدولي؛ لذا عُنيت المملكة بحماية هؤلاء المستثمرين، انطلاقًا من الشريعة الإسلامية -المستمدة من الكتاب والسنة-، واللذين يمثلان دستورها كما في المادة الأولى من النظام الأساسي للحكم، فقامت بمنحهم العديد من الحقوق والضمانات، كمساواتهم بالمستثمرين السعوديين من حيث الامتيازات والحقوق، وحماية استثماراتهم، وعدم سلبهم حقوقهم المستمدة بموجب قواعد وتنظيمات كانت موجودة عند منحهم تراخيص الاستثمار، وتوفير الحماية القضائية لهم عند الاعتداء على حقوقهم. وسيقوم هذا البحث بدراسة الضمانات والحقوق التي تقدمها المملكة العربية السعودية للمستثمرين الأجانب؛ دراسة مقارنة بين الشريعة والقانون. وتوصل البحث إلى العديد من النتائج، ومن أهمها: أن النظام السعودي جعل الشريعة الإسلامية هي المصدر الأساس في حماية المستثمرين الأجانب في المملكة العربية السعودية ومنحهم العديد من الحقوق الأساسية في الشريعة مثل: المساواة بين المستثمرين السعوديين والأجانب، وحماية استثماراتهم، وعدم الاعتداء على ممتلكاتهم إلا للمصلحة العامة مع منحهم تعويض عادل، وتسهيل عرض منازعاتهم أمام الجهات القضائية أو اللجوء إلى الوسائل البديلة للاسترداد، ومن أهم توصيات البحث: إنشاء دوائر قضائية متخصصة في تسوية منازعات الاستثمار الأجنبي في المحاكم التجارية.

Abstract 

Foreign investors in the Kingdom of Saudi Arabia play a major role in contributing to the development of the local economy and strengthening the relations of local investors with the international business community, this is why the Kingdom has given attention to protecting these investors, based on Islamic Law - derived from the Qur'an and Sunnah -, which are the ground norm of the country as entrenched Article One of the Basic Law of Governance, which bequeathed them with several rights and guarantees, such as equality with Saudi investors in terms of privileges and rights, protecting their investments, and not denying them their rights under the extant rules and regulations at the time they were granted investment licenses, and providing them with judicial protection when their rights are violated. This research will study the guarantees and rights offered by the Kingdom of Saudi Arabia to foreign investors; a comparative study between Sharia and law. The most important findings of the research include: that the Saudi government has made Islamic law the major source of protection of foreign investors in the Kingdom of Saudi Arabia and granted them several basic rights under the Islamic law, such as: equality between Saudi and foreign investors, and the protection of their investments, and not trespassing their property except for the public interest while granting them fair compensation, and facilitating the presentation of their disputes before the judicial authorities or resorting to alternative means of seeking redress, and the most important recommendations of the research include: the establishment of judicial departments specialized in the settling of foreign investment disputes in the commercial courts.
